Chapter 13 Bankruptcy is a debt repayment plan for wage earners who have the ability to repay at least a portion of their debts. Under the new bankruptcy laws, Chapter 13 Bankruptcy generally will be the only form of bankruptcy protection available to you if your income is above the North Carolina median income.

Filing for Chapter 13 gives you time to catch up on your bills, while consolidating and reducing the amount you owe creditors into one manageable payment. Through the bankruptcy court, our lawyers will help create a payment plan that will allow you to pay back some or all of what you owe to creditors over a three- to five-year period. For secured creditors (such as your home mortgage company and the IRS), you will need to pay back 100 percent of what you owe. Unsecured debts (such as credit card and hospital bills) will be reduced to monthly amount which you can afford to pay. At the end of the three- to five-year period, your unsecured debts will be discharged. You must also complete a credit counseling course before and after filing for Chapter 13 bankruptcy.
